California Crimes - Kidnapping / Carjacking
Kidnapping is committed when a person “forcibly or by any other means of instilling fear, steals or takes or hold, detains or arrests any person in one county and takes them to another county or state or country.” California Penal Code Section 207. The punishment for kidnapping ranges from 3 to 8 years unless the victim is under 14 years of age in which case the punishment can go up to 11 years. Kidnapping for the purpose for a ransom/robbery or for rape, is punishable by Life imprisonment. California Penal Code section 209 (a.)
Carjacking "is the felonious taking of a motor vehicle in the possession of another, from his or her person or immediate presence, or from the person or immediate presence of a passenger of the motor vehicle, against his or her will and with the intent to either permanently or temporarily deprive the person in possession of the motor vehicle of his or her possession, accomplished by means of force or fear." California Penal Code section 215. Carjacking is punishable by imprisonment in the state prison for a term of three, five, or nine years. If someone is killed in the process of carjacking then the death penalty can also be applicable.
