California Crimes - Cyber Crimes / Child Pornography

Other cases are charged under California Penal Code Section 311 which deals with distribution, possession or printing images depicting sexual conduct by minors. This statute applies to all possessing and publishing for sale or distribution of sexual conduct by a minor. This statute was amended in 1999 to include storing images on hardware, software or any storage medium including Cds and any printing of a computer generated image. Penal Code Section 311.3 makes a crime to even simply print a picture which depicts a person under the age of 18 engaging n sexual conduct. Penal Code Section 646.9 could be interpreted so that an email or a fax can result in charges for stalking being filed against one.
There are also computer hacking (unauthorized access to computers, systems and data) found in Penal Code Section 502. Such conduct as : knowingly accessing and without permission altering, damaging or destroying data, knowing accessing and without permission copying or taking any data or knowingly and without permission disrupting computer services, can a be a violation of this code section. This form of trespassing can be a wobbler and depending on the injury to the victim can expose the defendant to fines and state prison.
